The Flirty Guide Treasure Hunt Official Contest Rules

1. Eligibility: This contest is open to all US citizens and District of Columbia citizens 18 years of age or older. TFG Independent Contractors, Advertisers, and Sponsor(s) employees and members of their immediate families are ineligible to enter or win.

If you win a prize you will not be elgible to win a prize that same month. But be sure to enter again the following month.

2. Timing: The contest will start on January 6th, 2008 at 12:00AM PST and will run each week from Sunday 12:00 am (PST) to Saturday 11:59 pm (PST) each week and will end at TFG's discretion. TFG reserves the right to change or end this contest at any time without notice.

3. How to Enter:

1. Find the location of the treasure chest icon.

2. Go to the treasure hunt page and use the form in the right hand sidebar to send in your name, email and the name of the page the treasure chest was on.

3. If you send us the correct page you will be entered to win that week or month's fabulous prize! The winner will be chosen by random selection from all of the correct entries received.

4. You are allowed to enter the contest once per week. Multiple weekly entries will be disqualified.

Notification of Winners: Contest winners will be notified by their registered e-mail The Monday following the conclusion of the contest.. If a potential winner cannot be contacted or does not reply with a mailing address to ship their prize to within five (5) days after the first attempt to contact such potential winner, this will result in the selection of alternate winner. It is the winners responsibility to either email or call TFG at 408.338.9970 to give their mailing address to receive their prize. TFG is not responsible for bounced back emails or dropped calls and encourages all winners to both email and call to confirm their notification and to give their shipping address that they want their prize shipped to.

Winners will be required to provide eligibility proof (Name, address and age), and a mailing address their prize can be shipped to.

5. Prizes: Prizes will vary week to week.

TFG is not responsible for lost or mutilated prizes and none will be replaced. Prizes are nontransferable and must be accepted as awarded. No cash or other substitution may be made, except If the selected winner lives in a city or state where there is not a business establishment at which to redeem a gift card prize, an alternate prize of equal or greater value will be substituted by TFG.. All taxes, fees and surcharges on sponsored prizes are the sole responsibility of winner.

Winners are solely responsible for reporting and payment of any taxes on prizes.

6. Other Terms and Conditions:

(a) No purchase is necessary to enter or win.

(b) The contest is void where prohibited or where restricted by U.S., international, federal, state or local law.

(c) Entrants are required to provide truthful information. Sponsor(s) will reject and delete any entry (on-site, Internet, or mail-in) that it discovers to be false or fraudulent or to contain any incorrect statement.

(d) No further consideration will be provided to the contest winner.

(e)The winner will agree to hold TFG and it's Sponsors harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

(f) TFG and it's Sponsors are not responsible for technical, hardware, software or telephone failures of any kind, loss or delay of mail, lost or unavailable network connections, fraud or incomplete, garbled or delayed computer transmissions, whether caused by the Sponsors, users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human error which may occur in the processing of submission which may damage a user's system or limit an entrant's ability to participate in the contest. TFG reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or with the operation of the contest.

(g) Any and all disputes, claims and causes of action arising out of or connected with this contest, or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorney's fees.

(h)TFG reserves the right, in its sole discretion, but shall in no event be obligated, to cancel, terminate or suspend part or all of this contest should viruses, bugs, non-authorized human intervention, loss by any cause of mailed-in entry forms or other causes corrupt or impair the administration, security, fairness or proper play of the contest or for any other reason.

(i) New Gen Media, Inc. reserves the right to make changes to the rules of the contest, including the substitution of a prize or prizes of equal or greater value, which will become effective upon announcement and New Gen Media, Inc. shall incur no liability with respect to such changes.

(j) Failure to comply with the contest rules may result in an entrant's disqualification at the sole discretion of New Gen Media, Inc.

(k) The Contest shall be governed by and construed in accordance with the laws of the State of California, U.S.A. Entrants in the contest, the winners and their guests agree irrevocably to conform to the non-exclusive jurisdiction of the Courts of such State and hereby waive all defenses of lack of personal jurisdiction and forum non conveniens.
